New issue of a driving licence

A new driver's license must be issued after a previous revocation of the driver's license; only then is one again authorized to drive motor vehicles on public roads. However, since these are very complex and extensive cases that must be dealt with on a case-by-case basis, only a brief overview can be given here. The reasons alone that can lead to a revocation of the driver's license cannot be presented here in a comprehensive manner. A revocation of the driver's license is usually pronounced by a court within criminal proceedings with a ban or by a driver's license authority after determining the unfitness.

As a rule, following the judicial revocation proceedings, the driver's license authority informs the driver of the requirements for a new license, usually with a separate information letter.

The Bavarian State Government's brochure "Führerschein weg - was tun?", which can be downloaded free of charge from the Bavarian State Government's publications store, also contains information. As a rule, the responsible driver's license authority can also provide more detailed information in advance.

In principle, the regulations on the initial issuance of a driver's license also apply to the reissuance of a driver's license after revocation or surrender. This means that the driving license is not automatically reissued, but only upon application. In the case of an imposed driving ban, the application should be submitted in good time (about three to six months) before the end of the ban period.

In processing the application, the driving license authority must check whether the applicant is suitable and competent to drive a motor vehicle. The reasons that led to the revocation of the driving license must no longer exist. Furthermore, there must be no additional doubts about the applicant's fitness to drive; in such cases, a medical-psychological examination (MPU) would have to be ordered for clarification.

Such a driving suitability assessment must take place in many different cases already by law, for example if the driving license was revoked due to a drunk driving (with resulting unsuitability) or high promille values (in any case from 1.6 promille) were reached. The same applies in the case of repeated alcohol-related incidents or if the driver's license has been repeatedly revoked.
